Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the BRANDAnd.me platform ("the Platform"), operated by Beezi Global (NS0257809-W) ("we," "us," or "our"). By accessing or using our Platform, you agree to be bound by these Terms, our Privacy Policy, and all other policies referenced herein. If you do not agree with any part of these Terms, you may not use the Platform.
1. Platform Services
BRANDAnd.me provides a marketplace that connects brands seeking marketing services ("Brands") with influencers, content creators, and social media personalities ("Influencers") for the purpose of creating and managing marketing campaigns. We facilitate the connection and provide tools for campaign management, but we are not a party to the contractual relationship between Brands and Influencers.
2. User Accounts
To access certain features of the Platform, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Notify us immediately of any unauthorized use of your account.
3. User Conduct
You agree to use the Platform only for lawful purposes and in a manner that does not infringe on the rights of, or restrict or inhibit the use and enjoyment of, the Platform by any third party. You are strictly prohibited from:
- Engaging in any form of fraudulent activity, misrepresentation, or deceit.
- Using the Platform for any illegal or unauthorized purpose.
- Submitting false or misleading information, including account details or campaign performance metrics.
Consequences of Misconduct and Fraud: Any user found to be engaging in fraudulent activities, including but not limited to fraudulent transactions, misrepresentation, or any other illegal use of the Platform, will be immediately and permanently banned from the service. In such cases, all funds in the user's account will be frozen, and we reserve the right to report the fraudulent activity to the relevant financial institutions and law enforcement authorities.
4. Payments, Transactions, and Refunds
4.1 Payment Processing
All payments on the Platform are processed through a third-party payment provider, Stripe. By using the Platform, you agree to be bound by Stripe's terms of service and privacy policy. We are not liable for any issues or damages arising from the use of the third-party payment provider.
4.2 Platform Fees
You acknowledge and agree that we will deduct certain fees from transactions, including our platform commission and any transaction fees charged by the payment provider. All fees are non-refundable, even in the case of a refund being issued.
4.3 Refunds
Refunds for a campaign or transaction will be handled on a case-by-case basis and are subject to the following conditions:
- The request for a refund must be submitted through our official support channels within the specified period.
- Any refund issued will be processed to the original payment method used for the transaction.
- The refunded amount will be the original payment amount minus any non-refundable fees (e.g., payment provider transaction fees) that have already been incurred.
- Upon approval of a refund, we will initiate the refund process from our system within a period of 7 to 14 business days.
- Please be advised that after we have initiated the refund, the time it takes for the funds to appear in your bank account is dependent on your payment provider and financial institution. This may take an additional period of 30 to 45 business days. We are not responsible for any delays caused by banks or other payment processing intermediaries.
4.4 Withdrawal Limits
Influencers may withdraw their earnings from their Platform wallet. However, the Platform reserves the right to set and adjust minimum and maximum withdrawal amounts at any time. These withdrawal limits will be displayed in the user dashboard and may be updated periodically without prior notice. It is the user's responsibility to check the dashboard for the current withdrawal limits before initiating a withdrawal.
5. Dispute Resolution
In the event of a dispute between a Brand and an Influencer, we may, at our sole discretion, offer mediation services to resolve the issue. However, we are not obligated to do so and our role is limited to facilitating communication. We are not responsible for the outcome of any disputes and will not be held liable for any damages or losses incurred.
6. Limitation of Liability
To the maximum extent permitted by law, Beezi Global (NS0257809-W), its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, resulting from:
- The use or the inability to use the Platform.
- The cost of procurement of substitute goods and services.
- Unauthorized access to or alteration of your transmissions or data.
- The conduct of any third party on the Platform, including Brands, Influencers, or payment providers.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Kuala Lumpur, Malaysia.
